1.1 The Company: The company named Charlie's Parts & Technics, with company number BE1013.919.422, a sole proprietorship, located at Huttestraat 7, 1670 Bogaarden, email address: charliespartstechnics.vmv@gmail.com, and telephone number: +32(0)491/73.60.94.

1.2 The Customer: Any customer, a natural person, who habitually resides in Belgium and primarily acts with a private objective. The Company has a B2C relationship with this customer.

1.3 Products: All goods available for purchase on the Website.

1.4 The Agreement: The distance agreement concluded between the Company and the Customer for the purchase of Products via the Website. The Agreement is governed by these general terms and conditions.

1.5 Website: The Company's website: www.charliesparts.com.

2.1 These general terms and conditions apply to all legal relationships (including quotations, offers, purchase orders, and agreements) between the Company and the Customer.

2.2 Acceptance of the offer (explicitly or implicitly through payment) implies acceptance of these general terms and conditions.

3.1 Provisions or conditions that deviate from, amend, or supplement these terms and conditions shall only be binding on the Company if the Company explicitly agrees to them in writing.

3.2 If the offer and acceptance refer to different general terms and conditions, the contract is nevertheless formed. Both sets of general terms and conditions form part of the contract, except for incompatible clauses, unless the Company explicitly agrees to the incompatible clauses in writing.

3.3 The nullity of a provision or part of a provision under the Agreement shall not affect the validity of the remaining part of the provision or the other provisions and clauses.

4.1 The Agreement is concluded as soon as the Customer has accepted the offer and the general terms and conditions.

4.2 The Agreement and the general terms and conditions remain in effect until all obligations have been fulfilled.

5.1 The prices of the Products are those listed on the Website at the time the Customer places an order.

5.2 All prices include VAT at the current applicable rate in the Customer's country of residence.

5.3 All Product prices exclude delivery costs. Delivery costs are made available to the Customer on the Check-Out page after entering the delivery address. Delivery costs depend on the destination country for the Products.

5.4 Before placing an order, the total price, including all costs and taxes, will be made available to the Customer and displayed on the Check-Out page after entering the delivery address and choosing the delivery method.

5.5 If a Product is incorrectly priced on the Website, the Company will contact the Customer in writing as soon as it becomes aware of the incorrect price. The Customer will then have the option to proceed with the purchase of the Products or cancel the order in accordance with the cancellation procedure outlined in Article 7. If the Company is unable to contact the Customer using the contact details provided during the ordering process or does not receive a response from the Customer within three (3) days, the Company will treat the order as canceled and notify the Customer in writing.

6.1 The Company undertakes to deliver the Products within 72 hours of receiving full payment, unless another delivery date is agreed between the Company and the Customer at the time the Agreement is established.

6.2 If the Company is unable to deliver the Products within the above timeframe, it will inform the Customer in writing. The Customer will then provide the Company with a new, reasonable delivery deadline. If the Company fails to meet the deadline again, the Customer has the right to cancel the order.

6.3 The Customer will receive a confirmation email once the order has been assigned a Track & Trace barcode.

6.4 The Company will deliver the order to the address provided by the Customer during the purchase process.

6.5 If no one is available at the Customer's address at the time of delivery, the Customer must follow the instructions provided by the delivery service responsible for the order.

6.6 The Company reserves the right to make partial deliveries of the ordered Products, such as in situations where part of the order is delayed or unavailable. In case of partial delivery, the Company will notify the Customer in writing.

6.7 Upon delivery/collection, the Customer must inspect the packaging for any damage. If the Products are damaged, the Customer must not accept the delivery and must immediately inform the Company in writing. After notification, the Company will provide the necessary instructions regarding the damaged Products.

7.1 For certain Products (including starters and generators), the Company offers an exchange procedure at a reduced price. This procedure applies only if explicitly mentioned in the product description.

7.2 The exchange procedure is as follows: The Customer must contact the Company via email before placing the order to obtain a complete explanation of the procedure. Then, after payment is received, the Customer must first send the old part to the Company at their own expense. The Company will evaluate the old part for usability and document this with photos, which will be provided to the Customer. Upon approval, the reconditioned part will be delivered to the Customer.

7.3 If the old part does not meet the requirements, the Customer has the following options:

• Purchase the reconditioned part at full price (without the exchange discount), with payment of the remaining amount;
• Cancel the order, with a refund of the amount paid minus 15% as an administrative fee and the shipping costs for returning the rejected part.

7.4 The usability of the old part will be assessed based on the Company’s expertise, including the condition of the armature, mounting eyes, and pulley.

7.5 This exchange procedure does not affect the statutory warranty on the delivered reconditioned part as set out in Article 12.

8.1 The Customer has the right to cancel the order without providing a reason and without incurring costs before the order is dispatched.

8.2 The Customer can cancel the order through their account on the Website.

8.3 Upon cancellation of the order, the Customer will receive a cancellation confirmation via email through their account on the Website, and the Company will refund the amounts already paid to the credit or debit card used by the Customer to pay.

8.4 After confirmation that the Products have left the Company, the Customer can no longer cancel the order.

8.5 If it was not possible to cancel the order, the Products will be delivered, and the Customer may return the Product following the withdrawal procedure described in Article 9.

9.1 The Customer has a legal right to withdraw from the Agreement during the period specified in Article 9.2. This means that the Customer may decide not to retain the Products during this period. The Customer must notify the Company of their decision to withdraw from the Agreement and request a refund, in accordance with Article 9.4. The Customer is not required to provide a reason for the withdrawal.

9.2 The Customer has fourteen (14) days to withdraw from the Agreement. The starting point for the withdrawal period may vary. The following rules apply:

• c. If the delivery involves a single Product, the period starts the day after the Customer receives the Product.
• d. If the delivery involves multiple Products delivered on separate days, the period starts the day after the Customer receives the last ordered Product.
• e. If the delivery involves a Product over a specific period, the period starts the day after the Customer receives the first delivery of the Products.

If the Company has not provided the legally required information about the Customer's right of withdrawal, the Customer will have twelve (12) months to withdraw from the Agreement, starting from the day after the end of the initial fourteen (14) days. If the Company provides the legally required information within the twelve (12) months, the Customer has fourteen (14) days to withdraw from the Agreement from the day after receiving the information.

9.3 The Customer may only withdraw from the Agreement if the Products:

• Have not been assembled or used;
• Are complete;
• Retain their original labels and packaging in their original condition.

The Customer cannot exercise the right of withdrawal for:

• Service agreements after the service has been fully performed, if the execution began with the Customer's explicit prior consent and acknowledgment that they lose the right of withdrawal after the Agreement is fully performed by the Company;
• The delivery of goods or services whose prices depend on fluctuations in the financial market that are beyond the Company's control;
• The delivery of goods made to the Customer's specifications;
• The delivery of perishable goods or those with a limited shelf life;
• The delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons;
• The delivery of goods that, by their nature, are inseparably mixed with other products after delivery;
• The delivery of digital content not supplied on a physical medium.

9.4 If the Customer decides to withdraw from the Agreement, they must notify the Company by sending an email to charliespartstechnics.vmv@gmail.com, clearly stating their intention to withdraw from the Agreement.

9.5 The Customer must return the Products to the Company without undue delay and, in any case, no later than fourteen (14) days after sending the withdrawal notice to the Company.

9.6 All costs of returning the Products are borne by the Customer.

9.7 In case of withdrawal:

• The Company will refund the amounts paid by the Customer for the Products upon receipt of the Products;
• The Company will process all refunds within a reasonable timeframe after receiving the Products;
• The Company will refund the Customer to the credit or debit card used to make the payment;
• The Company reserves the right to refund the Customer with vouchers if vouchers were used to pay for the Products.

10.1 The Company is not liable for the non-performance or delay in the performance of its obligations under the Agreement if this is due to force majeure.

10.2 Force majeure is defined as any event beyond identifiable human control, such as but not limited to illness, death, or extreme and unforeseen weather conditions.

10.3 In the event of temporary force majeure, the Company's obligations are suspended, and the performance period is extended for the duration of the force majeure situation.

10.4 In the event of permanent force majeure, the Company is released from its obligations.

10.5 The Customer must ensure that the goods can be delivered and installed by the Company in a normal manner at the agreed place and time. If this is not met, the Customer is required to compensate all damages.

10.6 The Company is not liable for any compensation for damages, except in cases of willful misconduct or gross negligence.

10.7 The Company is not liable for indirect damages, such as loss of income, loss of contracts, or other consequential damages.

10.8 The Company's liability for direct damages is limited to the value of the ordered Products.

11.1 Goods remain the property of the Company until full payment of the principal amount, costs, and interest.

11.2 If goods are delivered by the Company, the risk transfers upon delivery.

11.3 If goods must be collected by the Customer, the risk transfers upon sale.

12.1 The Customer must immediately inspect the delivered goods and services upon receipt.

12.2 Any invoice is considered accepted unless protested by registered mail within 14 days.

12.3 The Customer is entitled to a statutory warranty of 2 years for new Products and 1 year for refurbished Products delivered via the exchange procedure (as outlined in Article 7). The statutory warranty covers any defect or non-conformity of the Products that manifests within the applicable warranty period from the date of delivery of the Products.

12.4 The Customer must inform the Company via email about defective Products within a reasonable time after the defect becomes known or could reasonably have been known to the Customer.

12.5 If a defect occurs within the two-year statutory warranty period, the Customer must follow the procedure defined in Article 9. After returning the defective Product, the Company, at the Customer's discretion, will either send a new Product or repair the Product and bear all costs associated with the exchange/repair of the Products. The Product can only be replaced and delivered if it is still available/in stock with the Company's suppliers. If repair or replacement is not possible or cannot be carried out within a reasonable time, the Customer has the right to terminate the Agreement, and the Company will refund the price in accordance with Article 9.7.

12.6 If the Customer has complaints, they may contact the Company via email at charliespartstechnics.vmv@gmail.com.

12.7 The Customer may also submit their complaint to the online dispute resolution platform provided by the European Union at http://ec.europa.eu/odr.

13.1 These terms are governed by Belgian law.

13.2 For any dispute concerning the application of these terms and the execution of the service, the courts of the district of Brussels have exclusive jurisdiction.

14.1 The Customer must pay at the time of placing the order using credit card, Bancontact, ApplePay, or PayPal.

14.2 If the Company does not receive full payment within 3 business days of receiving the order, it has the right to cancel the order.

15.1 The Company will only use the Customer's personal data in accordance with the Privacy Policy on the Website.

1.1 De Onderneming: de Onderneming met Ondernemingsnaam Charlie's Parts & Technics, Ondernemingsnummer BE1013.919.422 en rechtsvorm natuurlijke persoon gevestigd te Huttestraat 7, 1670 Bogaarden, met mailadres: charliespartstechnics.vmv@gmail.com en telefoonnummer: +32(0)491/73.60.94.

1.2 De Klant: iedere klant - natuurlijke persoon die gewoonlijk in België leeft en voornamelijk met een privédoel voor ogen handelt. De Onderneming heeft met deze klant een B2C-relatie.

1.3 Producten: alle goederen beschikbaar voor aankoop op de Website.

1.4 De Overeenkomst: de overeenkomst op afstand gesloten tussen de Onderneming en de Klant voor de aankoop van Producten via de Website. De Overeenkomst wordt beheerst door deze algemene voorwaarden.

1.5 Website: de website van de Onderneming: www.charliesparts.com.

2.1 Deze algemene voorwaarden zijn van toepassing op alle rechtsbetrekkingen (inclusief offertes, aanbiedingen, bestelbonnen en overeenkomsten) tussen de Onderneming en de Klant.

2.2 De aanvaarding van het aanbod (uitdrukkelijk of stilzwijgend door betaling) impliceert de aanvaarding van deze algemene voorwaarden.

3.1 Bepalingen of voorwaarden die van deze voorwaarden afwijken of die deze voorwaarden wijzigen of aanvullen, zijn voor de Onderneming slechts bindend indien de Onderneming uitdrukkelijk en schriftelijk met deze bedingen instemt.

3.2 Verwijzen aanbod en aanvaarding naar verschillende algemene voorwaarden, dan komt het contract niettemin tot stand. Beide algemene voorwaarden maken deel uit van het contract, met uitzondering van de onverenigbare bedingen, tenzij de onderneming uitdrukkelijk en schriftelijk met deze onverenigbare bedingen heeft ingestemd.

3.3 De nietigheid van een bepaling of een deel van een bepaling krachtens de Overeenkomst zal geenszins de geldigheid aantasten van het resterende deel van de bepaling of van de rest van de bepalingen en clausules.

4.1 De Overeenkomst is gesloten zodra de Klant het aanbod en de algemene voorwaarden heeft aanvaard.

4.2 De Overeenkomst en de algemene voorwaarden blijven van kracht tot alle verbintenissen zijn uitgevoerd.

5.1 De prijzen van de Producten zijn de prijzen die zijn vermeld op de Website op het moment dat de Klant een bestelling plaatst.

5.2 Alle prijzen zijn inclusief btw tegen het geldende huidige tarief in het land van verblijf van de Klant.

5.3 Alle prijzen van de Producten zijn exclusief leveringskosten. De leveringskosten zijn beschikbaar voor de Klant op de Check-Out pagina na het invullen van het leveringsadres. De leveringskosten zullen afhankelijk zijn van het land waarnaar de Producten moeten worden verzonden.

5.4 Alvorens een bestelling te plaatsen zal de totale prijs, inclusief alle kosten en belastingen, beschikbaar zijn voor de Klant en worden vermeld op de Check-Out pagina na het invullen van het leveringsadres en het kiezen van de leveringsmethode.

5.5 Als een Product niet correct geprijsd is op de Website, zal de Onderneming schriftelijk contact opnemen met de Klant zodra de Onderneming kennis krijgt van de onjuiste prijs. De Klant heeft in voorkomend geval de mogelijkheid om de Producten te blijven kopen of de bestelling te annuleren in overeenstemming met de annuleringsprocedure bepaald in artikel 7. Als de Onderneming er niet in slaagt om contact op te nemen met de Klant, gebruikmakend van de contactgegevens die de Klant tijdens de bestelprocedure heeft verstrekt, of als de Onderneming geen antwoord van de Klant ontvangt binnen een termijn van 3 dagen, behandelt de Onderneming de bestelling als geannuleerd en stelt ze de Klant daarvan schriftelijk in kennis.

6.1 De Onderneming verbindt zich ertoe de Producten te leveren binnen een termijn van 72 uren na volledige ontvangst van de betaling, tenzij een andere leveringsdatum wordt overeengekomen tussen de Onderneming en de Klant op het ogenblik dat de Overeenkomst tot stand komt.

6.2 Indien de Onderneming niet in staat is om de Producten binnen de bovenvermelde termijn te leveren, verbindt de Onderneming zich ertoe om de Klant hiervan schriftelijk op de hoogte te brengen. De Klant zal de Onderneming dan een nieuwe, redelijke leveringstermijn geven. Als de Onderneming de termijn opnieuw overschrijdt, heeft de Klant het recht om de bestelling te annuleren.

6.3 De Klant ontvangt een bevestiging via mail zodra de bestelling een Track & Trace barcode wordt toegewezen.

6.4 De Onderneming zal de bestelling leveren op het adres dat de Klant aan de Onderneming heeft opgegeven tijdens het aankoopproces.

6.5 Indien er op het moment van levering niemand beschikbaar is op het adres van de Klant, dient de Klant de instructies te volgen van de leveringsdienst die belast is met de levering van de bestelling.

6.6 De Onderneming behoudt zich het recht voor om gedeeltelijke leveringen van de bestelde Producten te verrichten, zoals maar niet beperkt tot de situatie waarin een deel van de bestelling vertraging oploopt of niet beschikbaar is. In geval van gedeeltelijke levering zal de Onderneming de Klant schriftelijk op de hoogte brengen.

6.7 Bij levering/afhaling dient de Klant de verpakking te controleren op eventuele schade. Als de Producten beschadigd zijn, mag de Klant de levering niet aanvaarden en moet hij de Onderneming onmiddellijk schriftelijk op de hoogte brengen. Na kennisgeving zal de Onderneming de Klant de nodige instructies geven met betrekking tot de beschadigde Producten.

7.1 Voor bepaalde Producten (waaronder startmotoren en generatoren) biedt de Onderneming een ruilprocedure aan tegen een gereduceerde prijs. Deze procedure is enkel van toepassing indien dit expliciet vermeld staat in de productbeschrijving.

7.2 De ruilprocedure verloopt als volgt: de Klant dient voorafgaand aan de bestelling contact op te nemen met de Onderneming via e-mail voor de volledige uitleg van de procedure. Vervolgens dient de Klant, na ontvangst van betaling, eerst het oude onderdeel op eigen kosten aan de Onderneming te bezorgen. De Onderneming beoordeelt daarop het oude onderdeel op bruikbaarheid en documenteert dit met foto's die aan de Klant worden bezorgd. Bij goedkeuring wordt het gereviseerde onderdeel aan de Klant geleverd.

7.3 Indien het oude onderdeel niet voldoet aan de vereisten, heeft de Klant de keuze tussen:

• Aankoop van het gereviseerde onderdeel tegen de volle prijs (zonder ruilkorting) mits bijbetaling van het resterende bedrag;
• Annulering van de bestelling waarbij het betaalde bedrag wordt terugbetaald, verminderd met 15% van het betaalde bedrag als administratiekost en de verzendkosten voor het terugsturen van het afgekeurde onderdeel.

7.4 De beoordeling van de bruikbaarheid van het oude onderdeel gebeurt op basis van de expertise van de Onderneming, waarbij onder meer wordt gekeken naar de staat van het armatuur, de bevestigingsogen en het katrolwiel.

7.5 Deze ruilprocedure doet geen afbreuk aan de wettelijke garantie op het geleverde gereviseerde onderdeel zoals bepaald in artikel 12.

8.1 De Klant heeft het recht om de bestelling zonder opgave van een reden en zonder kosten te annuleren vóór de verzending van de bestelling.

8.2 De Klant kan de bestelling annuleren via het account van de Klant op de Website.

8.3 Na annulering van de bestelling ontvangt de Klant een bevestiging van de annulering door verzending van een e-mail via de rekening van de Klant op de Website en zal de Onderneming de reeds betaalde bedragen terugbetalen op de kredietkaart of debetkaart die de Klant heeft gebruikt om te betalen.

8.4 Na ontvangst van een bevestiging dat de Producten de Onderneming hebben verlaten, kan de Klant de bestelling niet meer annuleren.

8.5 Indien het niet mogelijk was de bestelling te annuleren, worden de Producten geleverd en kan de Klant het Product terugsturen volgens de herroepingsprocedure beschreven in artikel 9.

9.1 De Klant heeft een wettelijk recht om de Overeenkomst te herroepen gedurende de termijn zoals bepaald in artikel 9.2. Dit betekent dat de Klant kan beslissen om de Producten gedurende de betrokken termijn niet te bewaren. De Klant moet de Onderneming conform artikel 9.4 op de hoogte brengen van zijn beslissing om de Overeenkomst te herroepen en een terugbetaling te ontvangen. De Klant hoeft geen reden voor de herroeping op te geven.

9.2 De Klant beschikt over veertien (14) dagen om de Overeenkomst te herroepen. Het beginpunt van de termijn om het herroepingsrecht uit te oefenen kan variëren. Volgende regels zijn van toepassing:

• c. Indien de levering één enkel Product is, begint de termijn te lopen de dag na ontvangst van het Product door de Klant.
• d. Indien de levering betrekking heeft op meerdere Producten die op afzonderlijke dagen worden geleverd, begint de termijn te lopen de dag nadat de Klant het laatste bestelde Product heeft ontvangen.
• e. Indien de levering betrekking heeft op een Product over een bepaalde periode, begint de termijn te lopen de dag volgend op de dag waarop de Klant de eerste levering van de Producten heeft ontvangen.

Indien de Onderneming de Klant niet de wettelijk vereiste informatie heeft verstrekt met betrekking tot het herroepingsrecht van de Klant, zal de Klant twaalf (12) maanden de tijd hebben om de Overeenkomst te herroepen vanaf de dag na het einde van de bovenvermelde eerste termijn van veertien (14) dagen. Indien de Onderneming de Klant de wettelijk vereiste informatie heeft verstrekt binnen de bovenvermelde termijn van twaalf (12) maanden, heeft de Klant veertien (14) dagen de tijd om de Overeenkomst te herroepen vanaf de dag nadat de Klant de informatie van de Onderneming heeft ontvangen.

9.3 De Klant mag de Overeenkomst alleen herroepen als de Producten:

• niet gemonteerd of gebruikt zijn geweest;
• volledig zijn;
• voorzien zijn van hun originele labels en verpakking in originele staat.

De Klant kan het herroepingsrecht niet uitoefenen met betrekking tot:

• dienstenovereenkomsten nadat de dienst volledig is uitgevoerd, indien de uitvoering is begonnen met de uitdrukkelijke voorafgaande toestemming van de Klant en met de erkenning dat hij zijn herroepingsrecht zal verliezen nadat de Overeenkomst volledig is uitgevoerd door de Onderneming;
• de levering van goederen of diensten waarvan de prijs afhankelijk is van schommelingen op de financiële markt waarop de Onderneming geen invloed heeft;
• de levering van goederen volgens specificaties van de Klant;
• de levering van goederen die snel kunnen bederven of beperkt houdbaar zijn;
• de levering van verzegelde goederen die om redenen van gezondheidsbescherming of hygiëne niet kunnen worden teruggezonden;
• de levering van goederen die na levering, volgens hun aard, onherroepelijk zijn vermengd met andere Producten;
• de levering van digitale inhoud die niet op een materiële drager wordt geleverd.

9.4 Indien de Klant beslist de Overeenkomst te herroepen, moet de Klant de Onderneming daarvan op de hoogte brengen door verzending van een e-mail naar charliespartstechnics.vmv@gmail.com, waarin ondubbelzinnig wordt verklaard dat hij de Overeenkomst wenst te herroepen.

9.5 De Klant moet de Producten terugbezorgen aan de Onderneming zonder onnodige vertraging en in ieder geval niet later dan veertien dagen na verzending van de kennisgeving van herroeping aan de Onderneming.

9.6 Alle kosten voor het retourneren van de Producten worden door de Klant betaald.

9.7 In geval van herroeping:

• zal de Onderneming de reeds door de Klant betaalde bedragen voor de Producten terugbetalen na ontvangst van de Producten;
• de Onderneming zal alle terugbetalingen uitvoeren binnen een redelijke termijn na ontvangst van de Producten;
• de Onderneming zal de Klant terugbetalen op de kredietkaart of debetkaart die de Klant gebruikt heeft om te betalen;
• de Onderneming heeft het recht om de Klant terug te betalen met vouchers als de Klant vouchers heeft gebruikt om de Producten te betalen.

10.1 De Onderneming is niet aansprakelijk voor de niet-uitvoering of vertraging in de uitvoering van haar verplichtingen krachtens de Overeenkomst indien dit te wijten is aan overmacht.

10.2 Onder overmacht wordt verstaan: ieder voorval dat buiten elk aanwijsbaar menselijk handelen om voorkomt zoals, maar niet beperkt tot, ziekte, een overlijden en extreme en onvoorziene weersomstandigheden.

10.3 In geval van een situatie van tijdelijke overmacht worden de verplichtingen van de Onderneming opgeschort en wordt de uitvoeringstermijn verlengd voor de duur van de situatie van overmacht.

10.4 In geval van een situatie van blijvende overmacht is de Onderneming bevrijd van haar prestaties.

10.5 De Klant dient te zorgen dat de goederen door de Onderneming op een normale manier kunnen worden geleverd en geïnstalleerd op de overeengekomen plaats en het overeengekomen tijdstip. Indien hieraan niet is voldaan, is de Klant verplicht alle schade te vergoeden.

10.6 De Onderneming is niet gehouden tot enige vergoeding voor schade, behalve in geval van opzet of zware fout.

10.7 De Onderneming is niet aansprakelijk voor indirecte schade zoals verlies van inkomsten, verlies van contracten of andere gevolgschade.

10.8 De aansprakelijkheid van de Onderneming voor directe schade is beperkt tot de waarde van de bestelde Producten.

11.1 Goederen blijven de eigendom van de Onderneming tot volledige betaling van hoofdsom, kosten en interesten.

11.2 Indien goederen door de Onderneming worden geleverd, gaat het risico over op het moment van levering.

11.3 Indien goederen moeten worden afgehaald door de Klant, gaat het risico over op het moment van de verkoop.

12.1 De Klant dient de geleverde goederen en diensten onmiddellijk na te kijken.

12.2 Iedere factuur wordt beschouwd als aanvaard, tenzij protest per aangetekend schrijven binnen de 14 dagen.

12.3 De Klant heeft recht op een wettelijke garantie van 2 jaar voor nieuwe Producten en 1 jaar voor gereviseerde Producten die via de ruilprocedure worden geleverd (zoals uiteengezet in artikel 7). De wettelijke garantie dekt elk defect of gebrek aan conformiteit van de Producten dat zich manifesteert binnen de toepasselijke garantietermijn vanaf de datum van levering van de Producten.

12.4 De Klant moet de Onderneming via mail informeren over de gebrekkige Producten binnen een redelijke termijn nadat het gebrek bekend is of redelijkerwijs gekend had kunnen zijn door de Klant.

12.5 Indien een gebrek zich voordoet binnen de wettelijke garantieperiode van twee jaar, moet de Klant de procedure volgen zoals bepaald in artikel 9. Na teruggave van het gebrekkige Product zal de Onderneming, naar eigen goeddunken van de Klant, de Klant een nieuw Product sturen of het Product repareren en zal de Onderneming alle kosten dragen in verband met de omruiling/reparatie van de Producten. Het Product kan alleen worden vervangen en geleverd in zoverre het nog steeds beschikbaar/in voorraad is bij de leveranciers van de Onderneming. Indien de herstelling of vervanging niet mogelijk is of niet binnen een redelijke termijn kan worden uitgevoerd, heeft de Klant het recht om de Overeenkomst te beëindigen en zal de Onderneming de prijs terugbetalen in overeenstemming met artikel 9.7.

12.6 Als de Klant klachten heeft, kan hij contact opnemen met de Onderneming via het e-mailadres charliespartstechnics.vmv@gmail.com.

12.7 De Klant kan zijn klacht ook indienen bij het door de Europese Unie ter beschikking gestelde onlineplatform voor geschillenbeslechting, http://ec.europa.eu/odr.

13.1 Deze voorwaarden zijn onderworpen aan het Belgische recht.

13.2 Voor elk geschil over de toepassing van deze voorwaarden en de uitvoering van de dienst zijn uitsluitend de rechtbanken van het arrondissement Brussel bevoegd.

14.1 De Klant moet betalen op het ogenblik van de plaatsing van de bestelling met creditcard, Bancontact, ApplePay of PayPal.

14.2 Als de Onderneming niet de volledige betaling ontvangt binnen 3 werkdagen na ontvangst van de bestelling, heeft de Onderneming het recht om de bestelling te annuleren.

15.1 De Onderneming gebruikt de persoonsgegevens van de Klant uitsluitend in overeenstemming met het Privacybeleid op de Website.

1.2 Le Client : tout client (personne physique) résidant habituellement en Belgique et agissant principalement dans un but privé. L’Entreprise entretient une relation B2C avec ce client.

1.3 Produits : tous les biens disponibles à l’achat sur le Site web.

1.4 Le Contrat : le contrat à distance conclu entre l’Entreprise et le Client pour l’achat de Produits sur le Site web. Le Contrat est régi par les présentes conditions générales.

1.5 Site web : le site web de l’Entreprise, à savoir www.charliesparts.com.

2.1 Les présentes conditions générales s’appliquent à toutes les relations juridiques (y compris les devis, offres, bons de commande et contrats) entre l’Entreprise et le Client.

2.2 L’acceptation de l’offre (expresse ou tacite par le paiement) implique l’acceptation des présentes conditions générales.

3.1 Les dispositions ou conditions qui dérogent aux présentes conditions, les modifient ou les complètent ne lient l’Entreprise que si celle-ci les accepte expressément par écrit.

3.2 Si l’offre et l’acceptation se réfèrent à des conditions générales différentes, le contrat est néanmoins formé. Les deux conditions générales font partie du contrat, à l’exception des clauses incompatibles, sauf si l’Entreprise a expressément accepté ces clauses incompatibles par écrit.

3.3 La nullité d’une disposition ou d’une partie d’une disposition du Contrat n’affecte en rien la validité du reste de la disposition ou des autres dispositions et clauses.

4.1 Le Contrat est conclu dès que le Client a accepté le devis et les conditions générales.

4.2 Le Contrat et les conditions générales restent d’application jusqu’à ce que tous les engagements aient été remplis.

5.1 Les prix applicables aux services sont ceux indiqués sur le Site web au moment de la commande. Les prix sont fixés à la tâche et sont exprimés en euros, TVA comprise.

5.2 Tous les prix incluent la TVA au taux en vigueur dans le pays de résidence du Client.

5.3 Tous les prix des Produits sont hors frais de livraison. Les frais de livraison sont disponibles pour le Client sur la page de validation de la commande après avoir renseigné l'adresse de livraison. Les frais de livraison dépendront du pays vers lequel les Produits doivent être expédiés.

5.4 Avant de passer une commande, le prix total, incluant tous les frais et taxes, sera disponible pour le Client et sera indiqué sur la page de validation de la commande après avoir renseigné l'adresse de livraison et choisi la méthode de livraison.

5.5 Si le prix d’un Produit s’avère incorrect sur le Site web, l’Entreprise contactera le Client par écrit dès qu’elle aura connaissance de cette erreur de prix. Le cas échéant, le Client aura la possibilité de poursuivre l’achat de ces Produits ou d’annuler la commande conformément à la procédure d’annulation prévue à l’article 7. Si l’Entreprise ne parvient pas à contacter le Client à l’aide des coordonnées fournies par le Client au cours de la procédure de commande, ou si l’Entreprise ne reçoit pas de réponse du Client dans un délai de 3 jours, l’Entreprise considérera la commande comme annulée et en informera le Client par écrit.

6.1 L’Entreprise s’engage à livrer les Produits dans un délai de 72 heures après réception intégrale du paiement, à moins qu’une autre date de livraison ne soit convenue entre l’Entreprise et le Client au moment de l’établissement du Contrat.

6.2 Si l’Entreprise n’est pas en mesure de livrer les Produits dans le délai susmentionné, elle s’engage à en informer le Client par écrit. Le Client indiquera alors à l’Entreprise un nouveau délai de livraison raisonnable. Si l’Entreprise ne respecte à nouveau pas le délai fixé, le Client pourra annuler la commande.

6.3 Le Client recevra une confirmation par e-mail dès que la commande aura quitté l’Entreprise.

6.4 L’Entreprise livrera la commande à l’adresse fournie par le Client à l’Entreprise au cours du processus d’achat.

6.5 Si personne n’est disponible à l’adresse du Client au moment de la livraison, le Client devra suivre les instructions du service de livraison chargé de livrer la commande.

6.6 L’Entreprise se réserve le droit d’effectuer des livraisons partielles des produits commandés, notamment dans le cas où une partie de la commande est retardée ou indisponible. En cas de livraison partielle, l’Entreprise en informera le Client par écrit.

6.7 Lors de la livraison ou de l’enlèvement, le Client doit vérifier que l’emballage n’est pas endommagé. Si les Produits sont endommagés, le Client ne peut pas accepter la livraison et doit immédiatement en informer l’Entreprise par écrit. Après notification, l’Entreprise donnera au Client les instructions nécessaires concernant les Produits endommagés.

7.1 Pour certains Produits (y compris les démarreurs et les générateurs), l'Entreprise propose une procédure d'échange à un prix réduit. Cette procédure est uniquement applicable si cela est explicitement mentionné dans la description du produit.

7.2 La procédure d'échange se déroule comme suit : le Client doit contacter l'Entreprise par e-mail avant de passer la commande pour obtenir une explication complète de la procédure. Ensuite, après réception du paiement, le Client doit d'abord envoyer l'ancienne pièce à ses frais à l'Entreprise. L'Entreprise évalue l'ancienne pièce pour son utilité et documente cela avec des photos qui sont envoyées au Client. Après approbation, la pièce révisée est livrée au Client.

7.3 Si l'ancienne pièce ne répond pas aux exigences, le Client a le choix entre :

• a. L'achat de la pièce révisée au prix plein (sans réduction d'échange) moyennant le paiement du montant restant ;
• b. L'annulation de la commande avec remboursement du montant payé, moins 15% du montant payé comme frais administratifs et les frais d'expédition pour le retour de la pièce refusée.

7.4 L'évaluation de l'utilité de l'ancienne pièce est basée sur l'expertise de l'Entreprise, en tenant compte notamment de l'état de l'armature, des œillets de fixation et de la poulie.

7.5 Cette procédure d'échange ne porte pas atteinte à la garantie légale sur la pièce révisée livrée telle que définie à l'article 12.

8.1 Le Client a le droit d'annuler la commande sans donner de raison et sans frais avant l'expédition de la commande.

8.2 Le Client peut annuler la commande via le compte du Client sur le Site Web.

8.3 Après annulation de la commande, le Client reçoit une confirmation de l'annulation par l'envoi d'un e-mail via le compte du Client sur le Site Web et l'Entreprise remboursera les montants déjà payés sur la carte de crédit ou de débit que le Client a utilisée pour payer.

8.4 Après réception de la confirmation que les Produits ont quitté l'Entreprise, le Client ne peut plus annuler la commande.

8.5 S'il n'était pas possible d'annuler la commande, les Produits sont livrés et le Client peut retourner le Produit selon la procédure de rétractation décrite à l'article 9.

9.1 Le Client a légalement le droit de se rétracter pendant la période prévue à l’article 9.2. En d’autres termes, le client peut décider de ne pas conserver les Produits pendant la période concernée. Le Client doit informer l’Entreprise, conformément à l’article 9.4, de sa décision de se rétracter et de recevoir un remboursement. Le Client n’est pas tenu de fournir une raison pour la rétractation.

9.2 Le Client dispose d’un délai de quatorze (14) jours pour se rétracter. Le point de départ du délai pour exercer le droit de rétractation peut varier :

• a. Si la livraison porte sur un seul Produit, le délai commence à courir le jour suivant la réception du Produit par le Client.
• b. Si la livraison porte sur plusieurs Produits livrés à des jours différents, le délai commence à courir le jour suivant la réception du dernier Produit commandé par le Client.
• c. Si la livraison concerne un Produit sur une période déterminée, le délai commence à courir le jour suivant la réception de la première livraison des Produits par le Client.

Si l’Entreprise n’a pas fourni au Client les informations légalement requises concernant le droit de rétractation, le Client aura douze (12) mois pour se rétracter du Contrat à compter de la fin du délai initial de quatorze (14) jours. Si l’Entreprise fournit ces informations dans le délai de douze (12) mois, le Client dispose alors de quatorze (14) jours pour se rétracter à compter de leur réception.

9.3 Le Client ne peut se rétracter que si les Produits :

• a. N'ont pas été assemblés ou utilisés ;
• b. Sont complets ;
• c. Portent leur étiquette d’origine.

Le Client ne peut pas exercer son droit de rétractation dans les cas suivants :

• a. Contrats de service après exécution complète, si commencés avec le consentement exprès du Client et en reconnaissant la perte du droit de rétractation ;
• b. Fourniture de biens ou services dépendant de fluctuations du marché financier échappant au contrôle de l’Entreprise ;
• c. Livraison de biens selon les spécifications du Client ou destinés à une personne spécifique ;
• d. Livraison de marchandises susceptibles de se détériorer rapidement ou à durée de conservation limitée ;
• e. Biens scellés ne pouvant être renvoyés pour des raisons de santé ou d’hygiène une fois descellés ;
• f. Biens irrévocablement mélangés à d’autres Produits après livraison ;
• g. Fourniture de boissons alcoolisées livrées après 30 jours et dépendant des fluctuations de valeur du marché ;
• h. Visites demandées par le Client pour des réparations urgentes, sauf services ou biens supplémentaires fournis ;
• i. Enregistrements audio ou vidéo ou logiciels descellés après livraison ;
• j. Journaux, magazines ou revues (sauf abonnements) ;
• k. Contrats conclus lors de ventes aux enchères publiques ;
• l. Fournitures de services ou de contenus numériques immatériels commencés avec consentement préalable du Client.

9.4 Si le Client décide de se rétracter, il doit en informer l’Entreprise par e-mail à charliespartstechnics.vmv@gmail.com, indiquant clairement son intention.

9.5 Le Client doit retourner les Produits sans retard excessif et au plus tard 14 jours après notification. Les Produits doivent être expédiés de la même manière que leur réception, avec l’étiquette de retour apposée.

9.6 Tous les frais de retour des Produits seront à la charge du Client.

9.7 En cas de rétractation :

• a. L’Entreprise remboursera les montants déjà payés dès réception des Produits, déduction faite de toute diminution de valeur causée par une manipulation inadéquate.
• b. Les remboursements seront effectués dans un délai raisonnable après réception des Produits.
• c. Les remboursements seront effectués sur la carte utilisée pour le paiement.
• d. Si des bons d’achat ont été utilisés, le remboursement sera également effectué sous forme de bons d’achat.

10.1 L’Entreprise n’est pas responsable de la non-exécution ou du retard de ses obligations en cas de force majeure. Le Client ne peut réclamer d’indemnité en cas de force majeure.

10.2 Par force majeure, on entend tout événement non causé par une action humaine identifiable, y compris, sans s’y limiter, une maladie, un décès, ou des phénomènes naturels extrêmes.

10.3 En cas de force majeure temporaire, l’Entreprise suspend ses obligations pour la durée de l’événement et informe le Client. Si la livraison est affectée, une nouvelle date sera convenue après la fin de l’événement.

10.4 En cas de force majeure permanente, l’Entreprise est libérée de ses obligations et en informe le Client.

10.5 Le Client doit garantir l’accessibilité des lieux de livraison. En cas de non-respect, le Client est tenu d’indemniser l’Entreprise pour tous dommages, y compris frais de garde et d’attente.

10.6 L’Entreprise s’engage à une obligation de moyens et n’est responsable que des dommages causés intentionnellement ou par négligence grave.

10.7 L’Entreprise ne peut être tenue responsable de dommages indirects tels que perte de revenus, contrats, ou capital.

10.8 La responsabilité de l’Entreprise pour dommages directs est limitée à la valeur des Produits commandés.

11.1 Les biens restent la propriété de l’Entreprise jusqu’au paiement intégral du montant principal, des frais et des intérêts.

11.2 Si les biens sont livrés par l’Entreprise, le risque est transféré au moment de la livraison.

11.3 Si la marchandise doit être enlevée par le Client, le risque est transféré au moment de la vente.

12.1 Le Client doit immédiatement vérifier les biens et services livrés.

12.2 Toute facture est considérée comme acceptée, sauf protestation par lettre recommandée dans les 14 jours.

12.3 Le Client a droit à une garantie légale de 2 ans pour les nouveaux Produits et 1 an pour les Produits reconditionnés livrés via la procédure d'échange (comme indiqué à l'article 7). La garantie légale couvre tout défaut ou non-conformité des Produits qui se manifeste pendant la période de garantie applicable à partir de la date de livraison des Produits.

12.4 Le Client doit informer l'Entreprise par mail des Produits défectueux dans un délai raisonnable après que le défaut est connu ou aurait raisonnablement pu être connu par le Client.

12.5 Si un défaut survient pendant la période de garantie légale de deux ans, le Client doit suivre la procédure définie à l'article 9. Après retour du Produit défectueux, l'Entreprise, à la discrétion du Client, enverra un nouveau Produit ou réparera le Produit et prendra en charge tous les frais liés à l'échange/réparation des Produits. Le Produit ne peut être remplacé et livré que s'il est encore disponible/en stock chez les fournisseurs de l'Entreprise. Si la réparation ou le remplacement n'est pas possible ou ne peut être effectué dans un délai raisonnable, le Client a le droit de résilier le Contrat et l'Entreprise remboursera le prix conformément à l'article 9.7.

12.6 Si le Client a des plaintes, il peut contacter l'Entreprise via l'adresse e-mail charliespartstechnics.vmv@gmail.com.

12.7 Le Client peut également soumettre sa plainte sur la plateforme en ligne de résolution des litiges mise à disposition par l'Union européenne, http://ec.europa.eu/odr.

13.1 Les présentes conditions sont soumises au droit belge.

13.2 Pour tout litige concernant l’application des présentes conditions générales et l’exécution du service, les tribunaux de l’arrondissement de Bruxelles seront les seuls compétents.

14.1 Le Client doit payer au moment de la passation de la commande par carte de crédit, avec Bancontact, ApplePay ou avec PayPal.

14.2 Si l'Entreprise ne reçoit pas le paiement complet dans les 3 jours ouvrables suivant la réception de la commande, elle a le droit d'annuler la commande.

15.1 L’Entreprise n’utilisera les données personnelles du Client que conformément à la politique de confidentialité figurant sur le Site web.
